The Tillamook County Board of Commissioners opened a public hearing on December 9, 2019 to hear the appeal of the Tillamook County Planning Commission’s decision to approve Application #851-19-000105-PLNG for a conditional use approval of a similar use determination and installation of the Jupiter Submarine Cable System, a fiber-optic cable system and landing site in Tierra Del Mar, in south Tillamook County. The public hearings process was a de novo hearing that followed the Oregon quasi-judicial land use hearing proceedings.
After strong deliberation of the Tillamook County Planning Commission’s decision to approve Conditional Use request #851-19-000105-PLNG and similar use determination in conjunction with this Conditional Use request, the Tillamook County Board of Commissioners voted 2 to 1 to uphold on both accounts the Tillamook County Planning Commission’s similar use determination and approval of the Conditional Use request. Commissioner Yamamoto and Commissioner Baertlein voted to uphold the Tillamook County Planning Commission’s decision and deny the appeal with the dissenting vote by Commissioner Bell. These decisions were made after consideration of the record for Conditional Use request #851-19-000105-PLNG, the staff report and exhibits for the appeal request, findings of fact, and all testimony presented and received during the public hearings process.
